Complaints about EHRC Commissioners lack of trans expertise

Postby James Morton on 24 Nov 2009, 19:25

FROM PRESS FOR CHANGE:

PLEASE FORWARD

The ECHR has appointed its new Commissioners - see announcement below:

Editor: As you will see from the announcement below, commissioners have been appointed to cover the strands of equality, there are 7 of these:
Rage & Ethnicity
Religion and Belief
Disability
Gender
Sexual Orientation
Age
Trans

The strands are covered - except one : Trans - once again we have been left out despite more than one experienced, and professionally qualified trans person applying. Perhaps now is the time to acknowledge that both the Government Equalities Office and the EHRC really do not understand or take seriously the issues face by trans people.

PFC will write formally and complain and encourage others to do so as well

NOTES FOR EDITORS

* The Government Equalities Office is responsible for the Government's overall strategy, legislation, and priorities on equality issues. The Office also has direct responsibility for policy on gender equality, sexual orientation, and for integrating work on race. It works to Ministers Harriet Harman, Maria Eagle, Vera Baird and Michael Foster.

* The Equality and Human Rights Commission is a statutory body established under the Equality Act 2006, which took over the responsibilities of Commission for Racial Equality, Disability Rights Commission and Equal Opportunities Commission. It is the advocate for equality and human rights in Britain. It aims to reduce inequality, eliminate discrimination, strengthen good relations between people, and promote and protect human rights. The Commission enforces equality legislation on age, disability, gender, race, religion or belief, sexual orientation or transgender status, and encourage compliance with the Human Rights Act and international treaties. It also gives advice and guidance to businesses, the voluntary and public sectors, and to individuals.

Evidently, they don't talk to each other in ECHR.

This is a subject which will hopefully unite all trans groups and underlines the three tier structure of society:

At the top: white cis-gendered males (sexual orientation or religious convictions immaterial)
In the middle: women, ethnic minorities, disabled, the elderly
The lowest of the low: trans people

Welcome to Animal Farm.
Best wishes

Whilst I agree that trans issues are often taken less seriously than discrimination against other minority groups by organisations such as the EHRC, I don't think it's particularly helpful to talk about any kind of hierarchy of oppression. Ultimately, women, ethnic minorities, the disabled, the elderly, sexual minorities, trans people and others are all oppressed against in different ways that are more or less serious in different contexts. The nature of this oppression also varies depending on how different oppressions might intersect for any given individual: for example, it might be that a given young, middle class, white trans woman is better off than a given elderly, working class black man. Or it might not be - it's highly contextual!

Anyways, my point is that we should surely be arguing from the perspective that all oppression is oppression, and we should be fighting it as such.

Maybe Gender Spectrum could submit some kind of official complaint to the EHRC about this?

I'm tempted to write to my MP and ask him to ask the minister responsible for appointing the commissioners why no trans commissioner has been appointed when several suitable candidates have applied.
Best wishes

Sounds like an excellent idea to me, Ruth

It might be worth looking at and discussing, even if a letter doesn't get sent. One benefit might be to keep us in the public eye. The risk, I suppose, is putting their noses out of joint.

It is a judgement call, really.

There are various ways to phrase such a letter - it doesn't need to be angry and negative. You could do a more balanced approach letter similar to those Christine Burns has done to the EHRC in the past. For example, you could welcome the naming of internal EHRC Directors as “champions” of different strands (intended to try to ensure the Commission’s work on each separate strand and human rights receives a senior level overview and is appropriately coordinated and reported) and invite the new transgender 'champion' David Darton to speak to a few of you in person or via Skype (emphasising that you are a UK-wide unfunded equality group which uses the internet tools (forum and skype) to coordinate as traveling to meet in person can be too expensive). You could express disappointment and concern that none of the EHRC Commissioners appear to have any particular knowledge of transgender equality issues. You could express interest in finding out from David Darton more about the EHRC's strategic/foresight plans for improving transgender equality and human rights. You could express some concern that previously the EHRC has not appeared to be consistent in its level of commitment to transgender equality and has appeared not to do much to assist transgender equality work in the UK and say that you hope that this will change in the future. You can say you remain committed to working constructively with the EHRC and hope they will work more closely with all national transgender equality groups (older and newer, funded and unfunded) to help improve transgender community engagement with public authorities to improve transgender equality and rights across the UK.
